  1. General Terms and Conditions of Using the Service
  1. This Regulation defines the rules of using the Service, the types of Products sold through the Service, the terms of placing Orders, the methods of concluding Agreements, the rules of payment, the conditions and deadlines for delivering Orders, the conditions for withdrawing from Agreements concluded via the Service, the procedure for handling complaints in case of placing Orders via the Service, and the technical requirements that equipment must meet in order to use the Service.
  2. The Regulation is addressed to both consumers and entrepreneurs using the Service, unless the content of the Regulation indicated that a specific provision is addressed exclusively to consumers and entrepreneurs.
  3. The information about the Products provided on the Service, in particular their descriptions and prices, is nor an offer within the meaning of Article 66 of the Civil Code, but only an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code.
  4. The Service Regulations are available at all times on the website https://www.wojtyczamakeup.com/ free of charge. The Service user has the possibility to print this regulation at any time.
  5. The user is obliged to use the Service only with the use of correct personal data.
  6. By using the Service, the user is obliged to comply with the provisions of th eRegulation and comply with the general applicable provisions of Polish law and the law of the European Union.
  7. Sales via the Service are conducted 24 hours a day, 7 days a week. Due to technical reasons the use of the Service may be temporarily restricted or disabled.
  8. The Buyer is prohibited from providing content of an unlawful nature, in particular by sensing content prohibited by law.
  9. The Buyer has the option of leaving a comment on the Service. The owner of the Service is not responsible for the content of the comments left on the Service and reserves the right to delete comments containing offensive or vulgar language, inconsistent with the law, in the form of spam or containing links to other sites that have been posted without the consent of the owner of the Service.
  10. The Buyer is entitled to use the Service only for personal use. In particular, it is prohibited for the Buyer to use any information contained in the Service for commercial purposes.
  11. The distribution or sharing of purchased Products, as well as their fragments, is permissible only after obtaining the consent of the owner of the Service, in writing, under penalty of invalidity.
  12. Subject to the absolute provisions of the Act of 4 February 1994 on copyright and related rights (Journal of Laws of 2022, item 2509, as amended), the Client is not entitled to distribute or share purchased Products, their fragments, copies for commercial purposes, make any modification to the file, or delete file errors.
  13. The condition for using the services provided on the Service is to use a device communicating with the Internet equipped with an Internet browser, having an active e-mail account, enabling Cookies and Javascript in the Internet browser, and having access to the Internet.
  14. Browsing of the products available in the Service is free of charge.
  15. All rights to the Service, including property rights, belong to the Owner of the Service. The protection provided for by the Act of 4 February 1994 on Copyrights and Related Rights (Journal of Laws of 2022, item 2509, as amended) applies to both the document templated and online courses published on the Service, as well as to the logos, photos, and forms posted on the Service.
  1. The rules of Product sales
  1. To purchase products, you need to go to the website https://www.wojtyczamakeup.com/ and create an account.
  2. Creating an account on the website required providing the buyer’s first and last name or company name, address of residence or headquarters, email address, and creating a password necessary for logging in. In the case of entrepreneurs you must also provide the NIP number.
  3. The customer can pay for the order by electronic bank transfer.
  4. All product prices on the website are quoted in Polish złoty and are gross prices, which means that they include VAT and income tax.
  5. Each proce listed on the website applies to one product unit.
  6. Purchasing a product ensures lifelong access to the material.
  7. Order fulfillment begins after the buyer receives confirmation of successful payment from the payment operator.
  8. Once confirmation of payment is received, the buyer immediately gains access to the course/document template.
  9. The website is not responsible for failure to deliver the email containing the link that enables access to the purchased product if it is caused exclusively by reasons attributed to the buyer, such as an incorrect email address or an overloaded email inbox.
  10. A VAT invoice will be issued to the buyer in the case of selecting the option „Ordering as a company” and providing the company name, registered office address, and NIP number.
  11. The range of products offered on the website and their prices might change. The price change does not apply to orders placed just before the new pricing terms come into effect.
  1. Complaint Procedure
  1. In case of objections to the operation of the Service, the Buyer is entitled to submit a complaint.
  2. Complaints are considered immediately, but no later than within 14 days from the date of receiving the postal delivery or delivery of the email containing the complaint.

  1. Right of withdrawal from a distance contact
  1. A consumer who has entered into a distance contract with the Owner of the Service may withdraw from it within 14 calendar days without giving any reason and without incurring any additional costs, subject to further provision of the Regulations.

  4. The consumer does not have the right to withdraw from a distance contract for a digital product that is not recovered on a tangible medium if the performance had commenced with the consumer’s prior express consent and acknowledgement that he or she thereby loses his or her right to withdrawl.
  5. For the purposes of the preceding paragraph, the term „performance of the service” shall mean access to digital content.
  6. The consumer shall be refunded the payment made within 14 days from the date on which the Service Owner receives the consumer’s statement regarding withdrawl from the contract,
  7. The Service Owner shall refund the payment using the same method of payment that the consumer used to pay for the product.

  1. Some areas of the Website may use cookies, which are small text files sent to the user’s computer that allow for identification and simplification or termination of a specific operation. Cookies are harmless to the user’s computer, data contained therein, and the user.

Detailed information on the possibility for consumers to use out-of-court methods of handling complaints and claims, as well as the rules of access to these procedures, is available on the website of the Office of Competition and Consumer Protection at the following address: https://uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php.
  2. In addition, buyers have the possibility of obtaining information about their rights and obligations, including those related to amicable settlement of disputes, at the contact point operating under the President of the Office of Competition and Consumer Protection.
  3. The consumer has, among other, the following possibilities to use out-of-court methods of handling complaints and claims: a) submission of a dispute to a permanent consumer arbitration court (more information on the website: http://www.spsk.wiih.org.pl/); b) Submission of a request for out-of-court dispute resolution to the voivodship inspector of the Trade Inspection; c) Assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Federation of Consumers, Polish Consumers Association). Advice is provided, among others, by email at: [email protected] and by calling the consumer helpline at 801 440 220 (the helpline is open on business days from 8:00 to 18:00, call charges are determined by the operator’s tariff).

This interactive and multilingual platform serves as a point of service for both consumers and businesses seeking out-of-court settlement of a dispute related to contractual obligations arising from an online sales agreement or service agreement.
  1. Changes to the regulations
  1. The owner of the Service reserves the right to make changes to these regulations to the extent permitted by applicable law.

  2. The owner of the Service reserves the right to unilaterally change the regulations to the extent that they have not been individually agreed with the User for justified reasons.

  3. Justified reasons, as referred to the preceding paragraph, include in particular: a) changes in universally applicable laws in the Republic of Poland that require changes to certain provisions of the regulations; b) the need to supplement, clarify, or modify the regulations in order to ensure greater transparency to their content or to adapt them to the applicable laws in the territory of the Republic of Poland; c) the introduction of new or modification of existing functionalities of the Service to the extent that the introduced changes affect the content of regulations; d) the introduction of new or modified of existing IT systems to the extent that the introduced changes affect the content of the regulations, and the modification of the regulations is necessary and directly related to the introduction of new or modification of existing IT systems; e) the issuance of a judgement in civil or administrative proceedings from which it follows that the content of the regulations is contrary to the law;

  4. Changes to the regulations do not apply to contracts concluded before the date of their entry into force. The regulations in their previous version apply to contracts concluded before the changes to the regulations enter into force.

  5. The owner of the Service informs the User about the proposed changes to the regulations by publishing in the Service a) the planned changes to the regulations; b) the date of entry into force of the changes to the regulations; c) the introduction of new functionalities in the Service or modifications to existing functionalities to the extent that new functionalities or modified functionalities affect the content of the regulations; d) the uniform content of the regulations (taking into account the changes introduced).

  6. These regulations come into force on March 30, 2023.
